Terms of Service

Please read this Usership Agreement carefully before using www.Gang-Wars.com (the "Site"). By using the Site, you signify you understand, and agree to be bound by, the terms and conditions of this Usership Agreement. If you do not agree to this Usership Agreement, please do not use the Site.

The terms and conditions of this Usership Agreement are subject to periodic change at Gang-Wars discretion. As such, each User of the Site ("User" or "you") agrees to review this Usership Agreement periodically in the section of the Site entitled "Usership Agreement"

ACCOUNT ACTIVATION
No purchase or paid access is required for participation in Gang-Wars.Only Users who have successfully completed the Gang-Wars User Activation process ("Account Activation") found on the Site may participate in Gang-Wars and are eligible to win prizes on the Site. Such prizes are subject to eligibility restrictions, rules and requirements as published in this Usership agreement.

You must be at least 18 years of age at the time of Account Activation or have written consent for a parent or guardian sent to Gang-Wars prior to registering. To participate in Gang-Wars, you must read and agree to be bound by the terms and conditions of this User agreement. You may not use the services offered via the Site if you reside in an area where such services are prohibited, regulated or taxed (other than any income or withholding taxes that relate to receipt of prizes).

User SUPPLIED INFORMATION
When a User chooses a screen name, or otherwise creates a label or public message that can be seen by other Gang-Wars Users, the User must abide by the rules of common decency. If Gang-Wars, in its sole discretion, finds such a label offensive, it reserves the right to change the name, remove the label and/or suspend the User.

Electronic Newsletters
Gang-Wars emails a free informational electronic newsletter to our users three times a week. Users may remove themselves from this mailing list by utilizing the links within the emails to delete their accounts.

LIABILITY OF Gang-Wars
Gang-Wars is not liable for any malfunction or failure of its systems, Site or service offering due to matters including, but not limited to, force majeure, the failure of Gang-Wars's or any other entity's software, hardware or communications technology or any part thereof, delays, losses, errors, or omissions resulting from failure of any telecommunications or any other data transmission system, any act of God, any outbreak of hostilities, riot, civil disturbance, acts of terrorism, the acts of Government or authority (including refusal or revocation of any license or consent), fire, explosion, flood, theft, malicious damage, strike, lockout or industrial action of any kind.

In the event that a disconnection occurs during a game, your account will only reflect any successfully processed changes made prior to the time of the disconnection.

It is your sole responsibility to understand and abide by any federal, state, local or foreign tax laws that may apply to your receipt of prizes. You understand that you may be required to complete certain Internal Revenue Service ("IRS") tax information reporting forms prior to your receipt of any winnings, prize or prizes. You further understand that Gang-Wars may be required to provide information regarding your winnings to the IRS or any other foreign government agency that requests such information concerning its citizens.

IMPROPER CONDUCT
Any User accused of harassing another User in general or private communications will be warned by Gang-Wars (note that it is important that all such accusations include the time of the harassing behavior). If a second complaint is filed, Gang-Wars will determine, in its sole discretion, from the logs (Gang-Wars must be notified of the harassment within 24 hours of its occurrence) whether the User has been offensive. If so, Gang-Wars reserves the right to suspend the User from Gang-Wars for a period of time to be determined in Gang-Wars sole discretion.

Gang-Wars, in its sole discretion, may disqualify a User from participation in the use of any or all portions of the Site if such User engages in any conduct that Gang-Wars deems to be improper, unfair or otherwise adverse to the operation of the Site or detrimental to other Users of the Site.

There is a limit of 2 non-registered accounts per location. This includes but not limited to house, apartment, IP address, office, internet cafe, or school. Users found to be playing more then 2 non-registered accounts will have all accounts suspended (including any additional registered accounts).

TRADEMARKS, COPYRIGHTS AND PROPRIETARY RIGHTS
Gang-Wars maintains the Site for your personal entertainment, information, education, and communication purposes. You may download material displayed on the Site for non-commercial, personal use only provided you also retain all copyright and other proprietary notices contained on the materials. You may not, however, distribute, modify, transmit, reuse, re-post, or use the content of the Site for public or commercial purposes, including the text, images, audio and video without Gang-Wars's written permission.

While Gang-Wars uses reasonable efforts to include accurate and up-to-date information in the Site, Gang-Wars makes no warranties or representations as to its accuracy. Gang-Wars assumes no liability or responsibility for any errors or omissions in the content of the Site.

Your use of and browsing in the Site are at your risk. Neither Gang-Wars nor any other party involved in creating, producing or delivering the Site is liable for any direct, incidental, consequential, indirect or punitive damages arising out of your access to, or use of, the Site. Without limiting the foregoing, everything on the Site is provided to you "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. Please note that some jurisdictions may not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. Check your local laws for any restrictions or limitations regarding the exclusion of implied warranties. Gang-Wars also assumes no responsibility, and shall not be liable for, any damages to, or viruses that may infect, your computer equipment or other property on account of your access to, use of, or browsing in the Site or your downloading of any materials, data, text, images, video or audio from the Site.

Any communication or material you transmit to the Site by electronic mail or otherwise, including any data, questions, comments, suggestions, or the like is, and will be treated as, nonconfidential and non-proprietary. Anything you transmit or post may be used by Gang-Wars or its affiliates for any purpose, including, but not limited to, reproduction, disclosure, transmission, publication, broadcast and posting. Furthermore, Gang-Wars is free to use any ideas, concepts, know-how or techniques contained in any communication you send to the Site for any purpose whatsoever including, but not limited to, developing, manufacturing and marketing products using such information, without any additional compensation to the User.

MISCELLANEOUS
Gang-Wars has not reviewed all of the sites linked to by the Site and is not responsible for the content of any off-site pages or any other sites linked to the Site. Your linking to any other off-site pages or other sites is at your own risk.

Gang-Wars does not represent or endorse the accuracy or reliability of any of the information, content or advertisements (collectively, the "Materials") contained on, distributed through, or linked, downloaded or accessed from services contained on this Site (the "Service"), nor the quality of any products, information or other materials displayed, awarded, or obtained by you as a result of a winning, an advertisement or any other information or offer in, or in connection with, the Service (the "Products"). You acknowledge that any reliance upon any Materials shall be at your sole risk.

The rules, regulations, terms and conditions contained herein represent the complete, final and exclusive agreement between Gang-Wars and the User, and supersede all prior agreements, representations and understandings between Gang-Wars and the User. This Usership Agreement may be terminated by Gang-Wars at any time. However, such termination does not affect the enforceability of the terms and conditions of this Agreement as they relate to acts and omissions during the period prior to such termination.

The User acknowledges that if any provision of this Agreement conflicts with any other rule, regulation, term or condition of the Site, the terms and conditions of this Agreement shall govern.
